Terms of Service

These Terms of Service ("Terms") govern your access to and use of TopWork at https://topwork.kz (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
TopWork is an online platform that helps job seekers and employers connect. We provide tools to create profiles, publish resumes and job listings, and communicate for hiring purposes. We are not an employer for listings posted by third parties unless expressly stated.
2. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a company, you represent that you are authorized to bind that company.
3. Accounts
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity that occurs under your account.
- You may sign in using supported third-party providers (such as Google, Yandex, or Facebook).
4. Acceptable Use
You agree not to:
- post false, misleading, illegal, discriminatory, or harmful content;
- misrepresent your identity, qualifications, or company affiliation;
- scrape, harvest, or collect user data without authorization;
- interfere with or disrupt the Service or its security;
- use the Service for spam, fraud, or any unlawful purpose;
- upload malware or attempt unauthorized access to systems or accounts.
5. User Content
You retain ownership of content you submit. By posting content, you grant TopWork a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as needed to operate and improve the Service. You represent that you have the rights necessary to submit the content and that it does not infringe third-party rights.
6. Job Listings and Resumes
Employers are solely responsible for their job listings and hiring decisions. Job seekers are solely responsible for the accuracy of their resumes and applications. TopWork does not guarantee employment, candidate quality, or hiring outcomes.
7. Third-Party Services
The Service may integrate with third-party authentication or other providers. Your use of those services is subject to their terms and privacy policies. TopWork is not responsible for third-party services.
8. Intellectual Property
The Service, including its branding, design, software, and content (excluding user content), is owned by TopWork or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute our materials without prior written permission.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, TopWork and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities arising from your use of the Service.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, misuse the Service, or if required for legal or security reasons. Provisions that by their nature should survive termination will survive.
12. Changes to the Terms
We may update these Terms from time to time. The "Last updated" date will change accordingly. Continued use of the Service after updates constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law principles, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
